Come 1 January 2009, the no smoking zones in private estates and buildings will be further extended to cover the following areas: Indoor public areas regardless of whether they are air-conditioned and shall include the multi-storey and basement car parks; Entrances and exits to indoor area of buildings and facilities (within 5 metres of the entrances or exits, where practicable); Playground and exercise areas. So, where can smokers light up after Jan 1? At their homes (may include balconies, corridors and void decks) as well as open spaces and public areas that do not flout the 5metres rule. It is the legal responsibility of the managers (includes any owner, occupier, lessee or person who is responsible for the management of the building) of a smoke-free place to ensure that staff, customers, members or visitors observe the smoking prohibition. The law requires no-smoking signs to be displayed in smoke-free areas. Failure to comply with the law is an offence and offenders are liable to enforcement actions.
